Loyalty Rewards Programme Terms & Conditions
1. When did we last update the Vuse Loyalty Programme?
2. About the Vuse Loyalty Programme
(a) The Vuse Loyalty Programme is governed by these terms and conditions (the “Loyalty T&Cs”).
(b) Our Loyalty T&Cs govern:
(i) the operation of our Vuse Loyalty Programme (“Loyalty Programme”);
(ii) the use of the member section of British American Tobacco (New Zealand) Limited’s (“we”, “our”, “us”) website www.vuse.com.au; and
(iii) any promotional activity and loyalty transactions that arise as a consequence of our Loyalty Programme.
(c) Participants, or prospective participants, in our Loyalty Programme should read these Loyalty T&Cs carefully and make sure they understand them before joining our Loyalty Programme.
(d) By participating in our Loyalty Programme, a Member (as defined below):
(i) agrees that they have read, understood and is legally bound by:
(A) these Loyalty T&Cs;
(B) our Terms and
(ii) consents to us sending them emails in relation to our Loyalty Programme and the promotion and marketing of our goods.
(e) We may amend these Loyalty T&Cs at any time (including retrospectively) without prior notice in our absolute and sole discretion. Any amendments will be posted on this page.
(f) Vusionry and Vuse are brands of ours.
(a) Our Loyalty Programme is for existing smokers and vapers who are at least 18 years of age or older.
(b) Membership of our Loyalty Programme is free. An individual (not organisations or groups) will automatically become a member (“Member”) of our Loyalty Programme when they create an account by signing up on our www.vuse.com.au website. For the avoidance of doubt, creating an account and joining our Loyalty Programme is the same.
(c) A Member must be a legal resident of Australia with a valid email address.
(d) At any time, a Member can only have one membership of our Loyalty Programme and only one account may be associated with a valid single email address.
(e) We reserve the right to refuse, terminate, modify or suspend membership of our Loyalty Programme at any time without prior notice or reason and in our absolute and sole discretion. If we suspect fraud, misrepresentation, abuse, or violation of these Loyalty T&Cs, we also have the right to take appropriate legal action.
(f) Membership of our Loyalty Programme is not transferable.
(g) Membership is not required in order to purchase products online at www.vuse.com.au.
(h) A Member:
(i) may be required to provide their full name, mailing address, email address, and date of birth and to create a password in order to create an account; and
(ii) is solely responsible for maintaining the accuracy and privacy of their account information and for updating it as required.
(i) If a Member believes their account has been compromised, they agree to immediately contact the Vuse Customer Service at firstname.lastname@example.org.
(j) Our employees are not eligible to participate in our Loyalty Programme. We reserve the right at any time to:
(i) limit the number of participants in our Loyalty Programme; or
(ii) change our Loyalty Programme Coupons (each a “Coupon”).
(k) A Member can at any time terminate their membership by providing written notice to Vuse Customer Service at email@example.com. The email must specify the Member’s name, address, phone number, and email address associated with the account, and confirm that the Member wishes to be removed from our Loyalty Programme. It may take up to seven (7) business days for the cancellation to complete. The Member acknowledges and agrees that, upon cancellation of their membership, they will forfeit any Vuse Points (“Vuse Points”) they may have earned and/or any Coupons that might otherwise have been available to them during their continued participation in our Loyalty Programme. If a Member wishes to return to our Loyalty Programme after cancelling their membership, they will be required to join our Loyalty Programme again starting with no Vuse Points or available Coupons.
(l) If we terminate our Loyalty Programme or if a Member’s membership is revoked, any Vuse Points or Coupons in a Member’s account or available to a Member prior to such termination or revocation will automatically expire with no compensation payable, and a Member’s access to our Loyalty Programme and its features will automatically terminate.
(m) A Member may still receive emails, including marketing emails, from us relating to their www.vuse.com.au account or pursuant to their www.vuse.com.au subscription.
(a) Our Loyalty Programme is a way in which we reward and thank our loyal customers for purchasing Vuse products and/or taking other Loyalty Programme-related actions. A Member may:
(i) purchase Coupons by spending Vuse Points;
(ii) earn Vuse Points for each dollar a Member spends on each qualifying transaction online at www.vuse.com.au, excluding other discounts, and items purchased with a gift card, or any Coupons.
(b) We may, in our absolute and sole discretion, provide additional Vuse Points in connection with certain transactions and promotions. For an eligible purchase or action to qualify for Vuse Points, a Member must:
(i) be enrolled in our Loyalty Programme; and
(ii) must be logged into their account prior to making such purchase or taking such action.
(c) Vuse Points and Coupons earned through our Loyalty Programme are non-negotiable and cannot be redeemed either in whole or in part for cash.
(d) Only the Member paying for products in a qualifying purchase may accumulate Vuse Points.
(e) If a Member returns items from a qualifying purchase or obtains Vuse Points through fraudulent or other activity that violates these Loyalty T&Cs, the appropriate number of Vuse Points originally earned from such purchase or activity will be automatically deducted from the Member’s account balance.
(f) Vuse Points and Coupons do not constitute property of any Member or any other person and may not be gifted, sold, or otherwise transferred, other than by Vuse or as otherwise expressly provided for in these Loyalty T&Cs, and any receipt or use of Vuse Points or Coupons in violation of these Loyalty T&Cs will render such Vuse Points or Coupons void.
(g) Member accounts, Vuse Points, or Coupons may not be shared or combined.
(h) Vuse Points earned may not be eligible for redemption until 24 (twenty-four) hours after they are awarded.
(i) Vuse Points will expire six (6) months after they are earned. The expiry date for each Vuse Point will be specified in a Member’s account. We reserve the right in our absolute and sole discretion to change the expiry date for Vuse Points at any time without prior notice.
(j) If a Member has concerns that a purchase or other action was not properly applied to their account, they should contact the Vuse Customer Service at firstname.lastname@example.org. The email must specify the Member’s name, address, phone number, and email address associated with his or her account, the date of the purchase or action, and the issue(s) they encountered. This email must be sent within 45 (forty-five) days after the purchase or action took place. We are not responsible for late notifications regarding purchases or actions not being credited to a Member’s account.
(k) A Member may purchase Coupons by using Vuse Points by signing into their account. Coupons may only be purchased online at www.vuse.com.au.
(l) A Member cannot combine Vuse Coupons with any other coupon or promotion. Vuse Points used to purchase Coupons will be deducted from the total Vuse Points available in a Member’s account.
(m) Vuse Points from multiple accounts may not be aggregated unless authorised by us.
(n) Taxes on Coupons may apply where required by law. A Member is solely responsible for any tax liability, including disclosure, related to their participation in our Loyalty Programme, including upon receipt of Vuse Points or redemption of Coupons.
(o) We reserve the right, at any time in our absolute and sole discretion and without notice, to change the Coupons, how a Member earns Vuse Points or purchases or spends Coupons, and how we evaluate and reward eligible purchases and other Loyalty Programme actions.
5. Collecting and using Vuse Points
(a) Vuse Points will be accumulated and stored on a Member’s account. Members can view their Vuse Points balance at any time by logging into their account.
(b) A Member can only earn Vuse Points on the portion of the total purchase paid for by cash.
(c) For every one (1) New Zealand Dollar (NZD) spent on any products at www.vuse.com.au (including GST and shipping costs), a Member will receive 10 Vuse Points. Where the total order does not amount to an exact rounded dollar (i.e. $19.90), amounts will be rounded down for the purposes of earning Vuse Points (i.e. $19.90 will result in one hundred and ninety (190) Vuse Points being earned).
(d) Vuse Points will be credited to a Member’s account no later than the next working day.
(e) Vuse Points cannot be earned on retrospective purchases.
(f) One-off, annual, or special Vuse Points or credits applied to an account will also be awarded in the following cases:
(i) 500 (five hundred) Vuse Points on signing-up (one-off); and
(ii) 250 (two hundred and fifty) Vuse Points if a Member leaves a review at www.vuse.com.au. (maximum 10 reviews)
6. How to spend Vuse Points
Vuse Points can be spent in two ways:
(a) purchasing cash Coupons (see section 7); or
(b) purchasing discount Coupons (see section 8).
7. Purchasing cash Coupons
(a) Members can purchase cash Coupons by using their Vuse Points which they can then apply against their order.
(b) The following redemption rates apply:
(i) a $1 NZD Coupon can be purchased by spending 100 Vuse Points;
(ii) a $2 NZD Coupon can be purchased by spending 200 Vuse Points,
and so on in lots of 100 points, for example:

(c) Members will have the ability to decide how many Vuse Points they would like to use when purchasing a single cash Coupon.
(d) Once purchased, each cash Coupon will have a unique code which the Member will need to input at the checkout for that cash Coupon to be applied against the order.
(e) A cash Coupon may not be exchanged or redeemed for cash.
8. Purchasing discount Coupons
(a) Members can purchase discount Coupons by using their Vuse Points which they can apply against their order.
(b) The following redemption rates apply:

20% off Coupon
(c) Once purchased, each discount Coupon will have a unique code which the Member will need to input at the checkout for that discount Coupon to be applied against the order.
(d) A discount Coupon may not be exchanged or redeemed for cash.
9. Collecting and using cash Coupons or discount Coupons
(a) Members can view their Coupon balance at any time by logging into their account.
(b) Once a Coupon has been used (i.e. when the unique code is used at the checkout), it cannot be used again, and a Member will be required to collect more Vuse Points to purchase further Coupons.
(c) The use of Coupons will not earn any Vuse Points, although a Member will earn Vuse Points on the portion of the total purchase paid for by cash.
(d) A maximum of one (1) Coupon can be used per order.
(e) Coupons will expire six (6) months after they are unlocked if they remain unused. The expiry date for each Coupon will be clearly specified in the email notification a Member receives when they purchase a Coupon. We reserve the right in our absolute and sole discretion to change the expiry date for Coupons at any time without prior notice. No compensation will be payable for unused Coupons that have expired.
10. Limitation of liability
(a) We or our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents will not be responsible for or liable for any loss or damage, however caused, in connection with our Loyalty Programme or a Member’s participation in it (in contract, tort (including negligence) or otherwise) for any (but not limited to):
(i) any cost (including tax liability) associated with accessing any website in relation to our Loyalty Programme, including that incurred in the provision of Coupons or Vuse Points;
(ii) access delays or access interruptions to our Loyalty Programme;
(iii) data non-delivery, loss, theft, mis delivery, corruption, destruction, or unauthorised access to a Member’s account or a Member’s Vuse Points;
(iv) loss or damages of any sort incurred as a result of dealing with or the presence of any third-party links on our Loyalty Programme site or on
www.vuse.com.au or use of any Coupons of our Loyalty Programme;
(v) computer viruses, system failures, technical issues or malfunctions which may occur in connection with a Member’s use of our Loyalty Programme site or
www.vuse.com.au, including hyperlinks to or from third-party websites;
(vi) any inaccuracies or omissions in our Loyalty Programme content or adverse consequences arising out of use or reliance on such information or content;
(vii) any claim arising out of or in connection with the termination of our Loyalty Programme;
(viii) any loss of profit (direct or indirect) or any direct, consequential, incidental or indirect loss or damage resulting from any breach of these Loyalty T&Cs; or
(ix) events beyond our reasonable control, including without limitation any act of God, act of war, natural disaster, cyberattacks, terrorism, or any act or omission of a third party.
(b) To the extent we or our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents remains liable to Members, its aggregate liability (in contract, tort (including negligence) or otherwise) in respect of any one event or related series of events under these Loyalty T&Cs is limited to the monetary value equivalent of the Coupons or Vuse Points in a Members account at the time of the event, or first event in the series, which gives rise to the liability.
(c) These Loyalty T&Cs are to be read in conjunction with any additional conditions associated with specific promotions, as well as in conjunction with our Terms and Conditions of Sale. In the event of any inconsistencies, our decision as to which terms prevail will be final and binding.
(d) Our decision in relation to all matters arising in relation to our Loyalty Programme is final and binding.
Each Member agrees to defend, indemnify and hold harmless us, our parent company, subsidiaries, affiliates, directors, employees, agents, partners, licensors, contractors, contractual partners, telecommunication providers, content providers, and assignees and their respective officers, directors, employees and agents from and against any and all liabilities, claims, actions, demands, damages, costs, losses and expenses (including reasonable legal fees) made by any third party due to or arising out of a Member’s participation in our Loyalty Programme in violation of any law, rule, regulation, guideline, or these Loyalty T&Cs, and/or a Member’s violation of any rights of another.
12. Law and dispute resolution
(a) Our Loyalty Programme and these Loyalty T&Cs are governed by the laws of Australia.
(b) Each Member consents to the exclusive jurisdiction and venue of the Courts within Australia, for any claims arising out of or relating to our Loyalty Programme or their participation in our Loyalty Programme.
